CRITICAL NOTICE

This service is designed to release your secrets after prolonged unresponsiveness. Once released, secrets CANNOT BE UNRELEASED. Use this service responsibly.

1. Agreement to Terms

By accessing or using Digital Heritage ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

2. Description of Service

Digital Heritage is a personal continuity and contingency planning service that allows you to:

  • Store encrypted secrets (passwords, notes, files)
  • Designate trusted contacts to receive access after prolonged missed check-ins
  • Set up periodic check-ins to confirm you are responsive
  • Grant specific trusted contacts (beneficiaries) access to specific secrets

2.1 How It Works

  1. You add secrets encrypted on your device before upload
  2. You add trusted contacts (beneficiaries) with unique access codes
  3. You check in periodically (daily/weekly/monthly)
  4. If you miss check-ins for 30 days, trusted contacts are notified
  5. Verified contacts can access their designated secrets

2.2 Critical Limitations

IMPORTANT LIMITATIONS:

  • NOT a will substitute: This does NOT replace a legal will
  • NO verification of status: We do NOT verify that you are deceased, incapacitated, or otherwise unreachable
  • Irreversible release: Once secrets are released, they CANNOT be unreleased
  • No emergency override: We cannot stop the release process once started
  • Trusted contact honesty: We rely on trusted contacts being honest about your status

3. Your Responsibilities

3.1 Accurate Information

You agree to:

  • Provide accurate beneficiary information (email addresses, names)
  • Keep your check-in frequency appropriate for your situation
  • Inform trusted contacts (beneficiaries) that you've added them to this service
  • Provide trusted contacts (beneficiaries) with instructions on accessing your secrets

3.2 Password and Security

  • You are responsible for maintaining the confidentiality of your master password
  • We CANNOT recover your master password if lost
  • If you lose your master password, your secrets are permanently inaccessible
  • You are responsible for all activities under your account

3.3 Beneficiary Communication

You MUST:

  • Inform trusted contacts (beneficiaries) that they've been added
  • Explain how the service works
  • Provide them with their access codes securely
  • Give them instructions on how to decrypt your secrets
  • Keep beneficiary information up to date

3.4 Regular Check-Ins

You agree to:

  • Check in according to your chosen frequency
  • Understand that missed check-ins will trigger trusted contact notifications
  • Understand that 30+ days of missed check-ins will release secrets to your trusted contacts (beneficiaries)
  • Not hold us liable if you forget to check in and secrets are released

4. Trusted Contact (Beneficiary) Terms and Conditions

4.1 Trusted Contact Obligations

As a trusted contact (beneficiary), you agree to:

  • Verify the user is unresponsive (including incapacitated or deceased) before accessing secrets
  • Use the access code only for its intended purpose
  • Keep the access code secure and confidential
  • Only access secrets you've been explicitly granted access to
  • Use the information ethically and legally

4.2 Access Verification

Trusted contacts must:

  • Verify email address before accessing secrets
  • Enter the correct 6-character access code
  • Understand that all access attempts are logged
  • Understand that accessing secrets when the user is still responsive is a violation of these Terms

4.3 Trusted Contact Liability

Trusted contacts are solely responsible for:

  • Verifying the user's actual status before accessing secrets
  • Any misuse of accessed information
  • Legal consequences of accessing or using the information
  • Keeping decrypted information secure

5. Encryption and Data Security

5.1 Client-Side Encryption

YOU ARE RESPONSIBLE FOR:

  • Choosing a strong master password
  • Keeping your master password secure
  • Providing trusted contacts (beneficiaries) with a way to decrypt your secrets
  • Understanding that if you lose your master password, your secrets are permanently lost

5.2 No Recovery Mechanism

CRITICAL: There is NO password recovery mechanism. If you lose your master password, your secrets are permanently inaccessible. We cannot help you recover encrypted data.

5.3 Trusted Contact Decryption

Trusted contacts (beneficiaries) receive encrypted secrets and files. To decrypt them, they need:

  • The encrypted secret data (provided by the Service)
  • Your master password (the same one you used to encrypt the secrets and files)
  • Instructions from you on how to decrypt (optional, but helpful)

It is your responsibility to provide trusted contacts (beneficiaries) with your master password through a separate, secure channel (e.g., written in your will, in a safe, or with a trusted executor).

Without the master password, the encrypted data is completely useless. Choose a strong master password and ensure your trusted contacts (beneficiaries) will have access to it.

6. Prohibited Uses

You agree NOT to:

  • Store illegal content or instructions for illegal acts
  • Store content that violates others' privacy or intellectual property rights
  • Use the service to harass, harm, or defraud others
  • Add trusted contacts (beneficiaries) without their knowledge or consent
  • Attempt to access others' secrets or accounts
  • Reverse engineer or attempt to bypass security measures
  • Use the service for any purpose other than its intended use

7. Secret Release and Irreversibility

⚠️ ONCE RELEASED, SECRETS CANNOT BE UNRELEASED

When secrets are released to trusted contacts (beneficiaries):

  • Trusted contacts can download the encrypted data
  • Trusted contacts may save, share, or use the information
  • We CANNOT revoke access once granted
  • We CANNOT delete the information from trusted contacts' devices
  • We have NO control over what trusted contacts do with the information

7.1 Release Conditions

Secrets are released automatically when:

  • You have missed check-ins for 30+ days
  • A beneficiary verifies their identity with the correct access code
  • The beneficiary's email has been verified

7.2 No Manual Override

We do NOT offer manual override or expedited release. Even if you provide proof of status or death, we will NOT manually release secrets. The system operates automatically based on the check-in mechanism.

8. Limitation of Liability

DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.1 We Are Not Responsible For:

  • Accidental release of secrets due to missed check-ins
  • Trusted contacts accessing secrets when you're still responsive
  • Loss of your master password
  • Trusted contacts losing access codes or decryption keys
  • Trusted contacts misusing accessed information
  • Data loss due to service interruptions
  • Security breaches beyond our control
  • Any consequential, incidental, or punitive damages

8.2 Maximum Liability

Our total liability to you for any claims relating to the Service shall not exceed the amount you paid (if any) for the Service in the 12 months preceding the claim. This is the maximum extent of our liability.

8.3 No Guarantee of Availability

We do not guarantee uninterrupted or error-free operation of the Service. The Service may be temporarily unavailable for maintenance, updates, or other reasons.

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account through the Service interface
  • Contacting us at support@digheritage.com

Upon termination, all your data will be permanently deleted within 30 days.

9.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You use the Service for illegal purposes
  • Your account poses a security risk
  • We are required to do so by law
  • We discontinue the Service

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days unless required by law to retain it longer.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction]. Any disputes arising under these Terms shall be resolved in accordance with these laws.

10.2 Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

10.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

11. General Terms

  • Entire Agreement: These Terms constitute the entire agreement between you and us
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any provision does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
  • Force Majeure: We are not liable for delays due to circumstances beyond our control
